View Full Version : Data Protection register
Hi All,
I've just be looking at the Data Protection Register thinking that I should register as I have an online shop (hopefully soon the Blue park one!!!). When I rang them the girl i spoke to said that as am only holding information for myself and not banking details (its all going through protx) that I don't need to register. Can someone clarify this for me should I be registering are you and if you what do you come under?
Thanks
Kate
Are you referring to www.dpr.gov.uk (http://www.dpr.gov.uk/). ?
Have a read of http://www.ico.gov.uk/for_organisations/data_protection_guide.aspx and see if any of the points apply to you.
Q: What do I need to do under the Data Protection Act? If you are required to comply with the Act, you have a number of legal responsibilities:
- to notify the Information Commissioner you are processing information, unless you are an organisation who has personal information only for:
staff administration (including payroll);
advertising, marketing and public relations for your own business; or
accounts and records (some not-for-profit organisations) - to process the personal information in accordance with the eight principles of the Act; and
- to answer subject access requests received from individuals.
Can't provide a legal opinion, but when looked into it, and to my understanding, as long as you are only using information internally to carry out normal business functions (as outlined in post above) then you do not need to be registered. It is for 'processors' of information that it is aimed.
We do our own packing / sending. If you were using a dropshipper / 3rd party, then not sure if that would then mean you do need to register.
Or if you were going to do joint marketing with another company (eg share your customer list), then that also maybe changes to you do need to register.
Have to admit i'd like to know the right answer to this as i've been given 2 different opinions. So maybe someone can confirm.
With regards to credit card info as far as i've been informed it is protx that holds the information not us, which is what we pay it to do.
